Social Service and ¡¸Social Welfare Services Act¡¹in Korea: Analyzing Their Regulatory Relationship

Abstract
This study aims to explain the relationship between Social Welfare Services Act(SWSA) as a set of institutional regulations and the formation and development of social service in Korea. That is, wether the relationship might represent the state of ¡°coupling¡± or ¡°decoupling¡± is to be analyzed based on the theoretical perspectives of new institutionalism as well as path dependency. This provides proper policy implications to this subject. The study is composed of what follows: constructing analytic concepts for social service as an industrial system, data gathering on the periodical revisions of SWSA, and analyzing those data as institutional regulation governing social service sector in Korea. The result shows the path of social service development has been closely related to the regulation system imposed by SWSA, and also shows the ¡°deterred adaptation¡± to the changed mode of providing newly introduced social services. This study also finds that the advent of the third generation social service (so called ¡°voucher social service¡±) has forced the existing path of SWSA regulation system for the all social services to be no longer proper. As a result, it suggests the proper action for the SWSA regulation system might be to decompose and reconstruct it as a ¡°basic act on social service¡± and many specialized acts for regulating various social services.
